July 11, 2025 – This month there was new activity in the ongoing effort to re-order the environmental process for federal actions, responding to changes in law, regulations, and judicial interpretation.
A new Supreme Court ruling narrows the scope of environmental reviews under NEPA, granting agencies greater discretion and likely reducing analysis of climate impacts in future infrastructure projects.
May 23, 2025 – The Senate this week created a new precedent that expands the Congressional Review Act with a work-around for the constraints of the GAO, the Parliamentarian, and the filibuster.
May 9, 2025 – The House continued its budget reconciliation process this week, with the Natural Resources Committee advancing a bill that includes changes to environmental review procedures, such as allowing project sponsors to pay for expedited, non-reviewable NEPA assessments, as well as broader regulatory reforms that may face challenges under Senate rules.
April 25, 2025 – The DOJ’s accidental filing of an internal memo explains in detail why the judge’s decision on congestion pricing is “exceedingly likely to be averse to the agency” and also advises steps that USDOT has and will take in the weeks to come.
April 11, 2025 – In a pretrial hearing this week, a federal judge set a timeline for the court case over the fate of New York City’s congestion pricing initiative.
