March 18, 2022 – On March 15, the U.S. Senate, in a bipartisan 57-40 vote, approved legislation (S. J. Res. 37) that would force the Biden Administration to lift its mandate that users of transportation facilities in interstate commerce and local mass transit wear face masks.

Most of the debate has focused on questions of market power and short-term shipper benefits, but one subject largely ignored is arguably the most important: the long-term impact of the rule on freight rail innovation and the viability of the mode itself.
